The People’s Olive Branch’s investigation led us to Republican Senator Debbie Mayfield as one of the culprits in the Florida State Senate…

Allegations are running rampant that Representative Daniel Perez went behind closed doors on behalf of HOA community associations and LCAM Property Management companies like FirstService Residential, to do his best to file down any teeth in HB-919 and SB-1114, which protected homeowners from felony theft and embezzlement by unethical Board of Directors. However, from our investigative research, these allegations are incorrect.

While The People’s Olive Branch’s investigation did lead us to Republican Senator Debbie Mayfield as one of the culprits. It must be corrected that Representative Daniel Perez did support the original provisions of the bill and the bill [HB-919] did pass the house with its original provisions in place that protected homeowners in the Great State of Florida against unethical HOA board members.

According to false allegations, Representative Daniel Perez did not show up at committee hearings to voice his opinions against HB-919 and SB-1114. Instead, incorrect allegations stated that Representative Daniel Perez went behind closed doors and had special provisions stricken from the bill that would protect homeowners of HOA community associations and Condo associations from felony theft and embezzlement by unethical board of directors and their property management companies that protect them.

However, these provisions were still in place when the bill passed the House and our sources say that it was not R-Perez who opposed these provisions, it was Republican Senator Debbie Mayfield who had qualms with the special provisions of the bill, which would have protected homeowners in Florida from felony theft and embezzlement by HOA Board of Directors.

The People’s Olive Branch did reach out to Daniel Perez’s office via email concerning this allegation. However, as of this publishing, we have not been able to get a response back from Representative Perez over this matter. Similarly, we have also not heard back from his legislative aide Andres Torres or his District Aide Maria Lombard.

From our investigative research, Republican Senator Debbie Mayfield is not a representative of the people. How can a party that claims to protect the people from communism and dictatorship push to remove homeowner protections to the benefit of organizations and board of directors that aim at running their HOA communities like a dictatorship?

SB-1114 along with HB-919 are bills that will still increase protections for residential HOA and Condo homeowners. In addition, the people of the Great State of Florida have Representative Juan Carlos Porras of District 119 to thank for sponsoring HB-919, amongst other provisions, and Ana Maria Rodriguez in the Senate for Sponsoring SB-1114. Under Section 3, subsection 4 “A director or an officer charged by information or indictment with any of the following crimes must be removed from office:

  1. Forgery of a ballot envelope or voting certificate used in a homeowners’ association election as provided in s. 831.01.
  2. Theft or embezzlement involving the association’s funds or property as provided in s. 812.014.
  3. Destruction of or the refusal to allow inspection or copying of an official record of a homeowners’ association which is accessible to parcel owners within the time periods required by general law, in furtherance of any crime. Such act constitutes tampering with physical evidence as provided in s. 918.13.
  4. Obstruction of justice as provided in chapter 843… If such criminal charge is pending against the officer or director, he or she may not be appointed or elected to a position as an officer or a director of any association and may not have access to the official records of any association, except pursuant to a court order.

Unfortunately for the people of the Great State of Florida, it does seem as if homeowners have representatives in the state that are not looking out for their best interest. The People’s Olive Branch has reached out to Republican Senator Debbie Mayfield with multiple questions and as of this publishing, we have not heard back from her office. However, we will update our report with any response and information provided by Senator Debbie Mayfield’s Office.
